State Tracker: CRT Legislation

Overview: There are now a number of states that are aggressively attempting to curb Critical Race Theory (CRT) and prevent it from being taught in the classroom or espoused by state agencies. Below is an up-to-date assessment of active or signed CRT bills.

Alabama
Summary: There is a State Board of Education resolution and a State House Bill in the works. The State Board of Education has introduced a resolution that would prohibit the teaching of CRT in public schools and prohibit the training of CRT to state employees. It also prohibits public schools from accepting any money (public or private) that is contingent on the school using it for CRT purposes. The House Bill would prohibit the teaching of CRT in public schools from kindergarten through higher education.

Arizona
Summary: Arizona currently has four bills relating to CRT. The first bill that has been introduced and passed strictly prohibits the teaching of any racist, sexist, or politicized instruction in Arizona schools. The second bill says that a state agency or a city, town, county, or political subdivision of the state may not require an employee to engage in training, orientation, or therapy that involves CRT. The third bill prohibits the state or local governments or agencies from requiring their employees to be trained in CRT. Finally, the last bill prohibits public schools from teaching CRT.

Arkansas
Summary: The state legislature in Arkansas passed legislation that bans state agencies from utilizing CRT in diversity training seminars and prohibits teaching within state agencies that the U.S. is an inherently racist country.

Florida
Summary: Florida Board of Education passed an amendment to 6A-1.094124, with Gov. DeSantis’ full support, banning ‘critical race theory’ and implementing new rules on how American history is taught in public schools to ensure CRT isn’t being used.

Georgia
Summary: The Georgia State Board of Education has passed a resolution prohibiting CRT in schools. Governor Kemp has approved it.

Idaho
Summary: Bans the teaching and promotion of CRT in all school districts, public schools, public charter schools, and publicly-funded institutions of higher education.

Summary: Bans the teaching and promotion of CRT in all school districts, public schools, public charter schools, publicly-funded institutions of higher education, and state agencies.

Kentucky
Summary: The first bill would ban the local board of education, school council, or public charter school from teaching CRT to students. The second bill would require the local board of education or board of a public charter school to ensure that no CRT is being taught in the classroom.

Louisiana

Michigan
Summary: SB 460 would instruct the board of directors or the board of a school district to ensure that students in public schools would not be taught CRT.  HB 5097 would prohibit core curriculum from including race or gender stereotyping.

Missouri
Summary: Bans the teaching and promotion of CRT and specifically the 1619 Project in all school districts, public schools, and public charter schools.

Montana
Summary: The State Superintendent of Public Instruction of Montana requested a legal opinion on CRT from the State Attorney General. AG Austin Knudsen said it is the duty of government officials to prevent racial discrimination even when it “comes disguised as anti-racist remedial measures.” He concluded that key elements of CRT are in violation of several laws.

New Hampshire
Summary: Bans the teaching and promotion of CRT in all school districts, public schools, public charter schools, institutions of higher education, state-funded contractors, and state agencies.

North Carolina
Summary: Prohibits the teaching or promotion of CRT in public schools by teachers, school administrators, or staff. This would extend to seminars, workshops, trainings, or any other educational or professional setting that could reasonably give rise to an appearance of an official sponsorship, approval, or endorsement by/of the public school.

Ohio
Summary: Prohibits public schools from incorporating CRT or the 1619 Project into the curriculum. The bill also prohibits the school or Board of Education to require teachers to affirm their beliefs of systematic racism, or the multiplicity/ fluidity of genders that go against a teacher’s religious or philosophical beliefs.

South Carolina 
Summary: This legislation would prohibit CRT and the 1619 Project from being taught in public schools. It would also require each school to publish on their website, all of the materials used for instruction in class; report the number of complaints regarding curriculum; and provide a phone number and email for parents/ guardians to use to contact the school for purposes of recommendations or suggestions on the curriculum.

Tennessee
Summary: Amendment added to a larger education bill that bans the teaching and promotion of CRT in all local education agencies (LEAs) and public charter schools. Additionally, the amendment withholds state funding for any entity found to be in violation.

Texas
Summary: Bans the teaching and promotion of CRT in all school districts, public schools, public charter schools, and state agencies. Additionally, includes instructions for the State Board of Education to develop social studies curricula that develop civics knowledge.

Status: H.B. 3979 has passed the Senate and is awaiting action by the governor. S.B. 2202 is in the Public Education Committee.

Utah
Summary: The Senate passed a resolution in a special session that would instruct the State Board of Education to look into whether or not CRT was being taught in schools and would strongly encourage them to remove CRT if they found it to be taught.

West Virginia
Summary: Bans the teaching and promotion of CRT in all school districts, public schools, public charter schools, state contractors, and state agencies. Additionally, it withholds funding to state entities found to be in violation.

Wisconsin
Summary: This bill would ban CRT in WI public schools and require all curriculum to be posted online for public access. If a school board violates the rules in the bill, they will lose 10% of their state funding.
